Overview

These Terms of Service (“Terms”) govern access to and use of PopTabs.store and related content, features, tools, products and services (collectively, the “Services”). The Services are operated by PTDirect, LLC under the trade name Pop Tabs Direct (“PopTabs.store,” “we,” “us” or “our”) and hosted by Shopify.

By visiting, using or purchasing through the Services, you agree to these Terms and the policies incorporated by reference, including our Privacy Policy, Shipping Policy and Return & Refund Policy. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be old enough to form a binding contract where you live to place an order. If products are intended for a classroom, youth group or minor, an authorized adult must place the order and supervise use.

You agree to provide accurate, current and complete information. You are responsible for protecting account credentials and for activity under your account. Notify us promptly of suspected unauthorized use.

2. Products, quantities and natural variation

PopTabs.store sells reclaimed aluminum beverage-can tabs in bulk quantities. We make reasonable efforts to describe and photograph products accurately, but screen settings and the reclaimed nature of the product mean that appearance varies.

Most tabs are silver, and colored tabs typically make up only a small natural portion of the mix. Color, finish, style, shape and minor cosmetic wear vary. Tabs are hand-reviewed before packaging but are not individually polished or color-sorted. A product photo is representative and does not promise a particular distribution of colors, shapes or finishes unless the product listing expressly says otherwise.

A quantity identified with a plus sign, such as 1,250+ or 10,000+, means the package contains at least the stated number of tabs. Packaging and shipment weight can vary.

3. Product safety and use

Pop tabs are small metal items, not toys or food. They may have rough, pointed or sharp areas and can present cut, puncture or choking hazards. Inspect each tab before use. Keep tabs away from children under 3 and anyone likely to place small objects in the mouth. Adult supervision is required for use by minors.

Crafting methods such as cutting, bending, sanding, drilling, linking or attaching tabs can create sharper edges, small fragments or project-specific hazards. Use appropriate tools, eye protection, hand protection and safe work practices. Tutorials, calculators and project ideas on the Services are general information, not professional safety, engineering or medical advice. You are responsible for deciding whether a product or project is appropriate for your intended use and users.

4. Collection drives and charity references

PopTabs.store is an independent seller and is not affiliated with, sponsored by or endorsed by Ronald McDonald House Charities or any other charity, hospital, school, nonprofit or collection program unless we expressly state otherwise in writing.

Programs set their own rules and may change them. Before buying, collecting, promoting or delivering tabs for a charitable or institutional purpose, confirm directly with the intended recipient whether it currently accepts the material, whether purchased tabs may be included, and what counting, condition, packaging and delivery requirements apply. We do not guarantee that any organization will accept or assign a particular value to purchased or collected tabs.

5. Orders and acceptance

Submitting an order is an offer to purchase. We may accept, reject, limit or cancel an order for reasons including availability, suspected fraud, pricing or listing errors, payment issues, shipping restrictions or misuse of the Services. An order is accepted when we confirm it or begin fulfillment, subject to applicable law.

Review the product, quantity, shipping address and contact information before submitting. Because eligible orders can ship the same business day, changes or cancellations are not guaranteed after checkout.

6. Prices, taxes and payment

Prices and promotions can change without notice. The price charged is the price shown when the order is submitted, subject to correction of obvious errors and applicable law. Taxes, international shipping, duties and other charges are shown or described at checkout when applicable.

You represent that you are authorized to use the payment method provided and authorize the applicable charges. We may use third-party payment and fraud-prevention providers to process and review transactions.

7. Shipping, delivery and returns

Fulfillment, delivery estimates, tracking, international charges and delivery issues are governed by our Shipping Policy. Returns, cancellations, damaged or incorrect orders and refunds are governed by our Return & Refund Policy. These policies are incorporated into these Terms.

8. Website content and intellectual property

The Services and their original text, graphics, photographs, videos, branding, logos, product presentation, calculators, downloads, page designs and other content are owned by or licensed to PTDirect, LLC and protected by intellectual-property law.

You may use publicly available guides and tutorials for personal, classroom or internal organizational use. Unless we give written permission, you may not copy, republish, sell, license, scrape, systematically extract, remove attribution from or create a competing content library from the Services. You may link to public pages on PopTabs.store.

Third-party names and trademarks belong to their respective owners. Reference to a third party does not imply affiliation, sponsorship or endorsement.

9. Reviews, feedback and submitted content

If you submit a review, photo, comment, suggestion or other content, you represent that you own it or have permission to submit it and that it is accurate, lawful and does not violate another person's rights. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, publish and display that content for operating and promoting the Services.

We may moderate or remove submitted content, but we are not obligated to do so. Do not submit confidential information through a public review or comment.

10. Third-party services and links

The Services may use or link to third-party platforms, payment services, carriers, social networks, apps or websites. Their services are governed by their own terms and policies. We are not responsible for third-party content or practices, except to the extent applicable law provides otherwise.

11. Shopify

Shopify hosts the store and provides technology used to deliver the Services. Purchases from PopTabs.store are transactions directly between you and PTDirect, LLC, not Shopify. Shopify is not the seller of our products. Personal information processed through the Services is handled as described in our Privacy Policy and applicable Shopify privacy notices.

12. Prohibited uses

You may not use the Services to:

• violate law or another person's rights;
• submit false, fraudulent, abusive, defamatory, obscene or malicious content;
• introduce malware, disrupt security or interfere with operation of the Services;
• collect personal information without authorization;
• impersonate another person or misrepresent affiliation;
• send spam or unauthorized promotions;
• bypass purchase limits, access controls or technical protections; or
• use automated means to scrape or extract substantial portions of the Services except as permitted by law or our written authorization.

We may suspend access, cancel orders or take other reasonable action in response to suspected prohibited conduct.

13. Errors and availability

We may correct typographical errors, inaccuracies or omissions involving descriptions, availability, pricing, promotions, shipping charges or transit information. We may update or discontinue products, tools or content without notice. If an error affects an accepted order, we will provide any notice, cancellation or refund required by law.

14. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT EXCEPT TO THE EXTENT A WARRANTY CANNOT LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE OR ERROR-FREE, THAT INFORMATIONAL TOOLS WILL PRODUCE A RESULT SUITABLE FOR EVERY PROJECT, OR THAT A CHARITY OR OTHER ORGANIZATION WILL ACCEPT TABS. PRODUCT RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE CONSUMER LAW REMAIN UNAFFECTED.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PTDIRECT, LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR OPPORTUNITY, ARISING FROM THE SERVICES, WEBSITE CONTENT OR PRODUCTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED, INCLUDING TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold PTDirect, LLC harmless from third-party claims, losses and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person's rights. This does not apply to the extent a claim was caused by our own unlawful conduct.

17. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except that mandatory consumer protections of your place of residence continue to apply when required by law.

Before filing a claim, please contact us and provide a reasonable opportunity to resolve the issue informally. Subject to mandatory law, legal proceedings relating to these Terms or the Services will be brought in a court of competent jurisdiction serving Walworth County, Wisconsin.

18. Severability and waiver

If a provision of these Terms is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of it.

19. Changes to these Terms

We may revise these Terms by posting an updated version and changing the “Last updated” date. Changes apply prospectively unless law permits otherwise. Continued use after the effective date means you accept the revised Terms.
